New York City Slip and Fall Attorney

Skilled Slip and Fall Injury Lawyer Fighting for the Maximum Compensation You Deserve

Every day in NYC, people lose their footing and fall. Whether you fell on the pavement, in a subway station, at a retail store, or another location, a slip and fall or trip and fall accident can be unexpected and result in severe injuries. Depending on the circumstances of your accident, a fall can cause you to suffer permanent physical limitations and lifelong disability.

The personal injury lawyers at The Edelsteins, Faegenburg & Brown have extensive experience obtaining substantial compensation for victims of slip, trip, and fall accidents. Due to our adept advocacy and skillful representation, we have secured millions in monetary damages for our clients — even in some of the most challenging slip and fall or trip and fall cases.

Dedicated Attorneys for Slip and Fall Accidents in New York City

When you walk through your neighborhood, to work, or go shopping, you shouldn’t have to worry about falling and getting hurt. Unfortunately, property owners sometimes fail to maintain their premises and allow conditions to deteriorate so much that they become hazardous. While not every fall results in a viable accident claim, an owner may be held liable for negligence if their failure to keep the property safe caused your injuries.

Some common conditions that lead to slip or trip and fall accidents can include:

  • Slippery or wet flooring
  • Uprooted sidewalks
  • Cracked concrete or pavement
  • Uneven surfaces
  • Faulty floormats
  • Defective stairs
  • Broken stairway railings
  • Misleveled elevators

If you are injured in a slip and fall or trip and fall accident, it is our job to prove that the accident was caused by a dangerous condition that the property owner knew about — or should have known about — and failed to correct in a timely manner. The hazardous condition must also have presented a risk that the victim could not have anticipated under the circumstances.

If the accident was due to another’s negligence, you may be entitled to receive compensation for your economic damages, including time lost from work, unreimbursed medical expenses, and out-of-pocket costs. You may also be able to receive monetary recovery for your non-economic damages for pain and suffering and loss of enjoyment of life.

Our slip and fall attorneys have decades of NYC experience litigating cases and have a track record of obtaining sizeable verdicts and significant settlements to compensate for our clients.

Diligent Counsel for New York City Sidewalk Accidents

Slip, trip, and fall cases are not always straightforward. There can be a number of variables involved and highly nuanced laws that apply — such as the New York City Sidewalk Law. Importantly, this law changed about 20 years ago to shield the City from financial exposure that could result in its being liable for the countless slip, trip, and fall accidents that happen on city sidewalks.

The City is generally not responsible for slip, trip, and falls that occur due to snow, ice, or cracks in the sidewalk. As a result of the change in the law, landowners and commercial property owners are responsible for maintaining the abutting sidewalk in a safe condition. However, liability may still fall on the City if a victim is injured due to a sidewalk condition in front of an owner-occupied one, two, or three-family residence.

It’s essential to be aware that when the City is a potential party in a slip or trip and fall accident, shorter statutes of limitation apply. In these cases, a written notice of claim must be served on the City within 90 days of the accident, or your claim may be forever barred. In addition, you only have one year and 90 days to commence a lawsuit against the City — as opposed to the three-year statute of limitations that generally applies.

The slip and fall attorneys at The Edelsteins, Faegenburg & Brown will meticulously investigate your claim to hold the proper party accountable and help ensure you receive the compensation you deserve.
